It may seem unusual, but there are many individuals in Israel today whose true or exact age is not known to state authorities. The date of birth listed on their ID cards does not correspond to their actual date of birth. In some cases, no specific date of birth is recorded at all, or only the birth year is listed without the exact date. Imagine, for example, a case where an individual who immigrated to Israel at the age of 30 is recorded by the authorities as being five years younger than their actual age. While this discrepancy might not affect much of their life, it would become a major issue upon reaching retirement age. They would need to wait an additional five years to qualify for pension benefits, even though they are theoretically already eligible. This is not a hypothetical scenario\u2014there have been numerous cases where individuals were denied rights due to inaccuracies regarding their true age.<\/p>\n

Why Are Errors in Age Registration Made in the First Place?<\/strong><\/p>\n

As is well known, Israel has welcomed immigrants from all corners of the globe. During periods of high immigration, mistakes sometimes occurred in recording and documenting immigrants’ data, including their true age. One of the reasons for this is Israel’s occasional skepticism regarding data from foreign countries. This issue extends beyond age to other areas, such as proving Jewish heritage for immigration purposes<\/a>.<\/p>\n

There are two main types of countries from which Israel may not fully recognize data or documents. The first includes countries where records and documentation are or were poorly maintained or otherwise deemed unreliable. The second includes enemy states, where the lack of formal diplomatic relations makes it difficult to obtain official data or involves extensive bureaucratic processes for document verification<\/a>.<\/p>\n

This law authorizes the Family Court to issue declaratory judgments compelling state authorities to recognize the true age determined by the court. It is important to note that the law acknowledges the difficulty of proving true age, allowing the court to accept evidence that might not otherwise be admissible or sufficient in other legal proceedings.<\/p>\n

For instance, in a June 2020 ruling<\/a>, the Family Court in Haifa approved an age determination request for a bank clerk who sought to adjust his official age to two years younger than recorded in the population registry. Witnesses, such as family members who could testify to his true age, had already passed away. The court relied primarily on archived bank records, which indicated that his true age differed from the one recognized by state authorities.<\/p>\n
